The Demise of the 28-Clause Peace Proposal for Ukraine: How Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension triggered by the announcement of a new 28-article proposal for achieving ceasefire appeared – temporarily – to have been stabilised. A American diplomat spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Moscow made its response: another massive barrage of aerial bombardment on Kyiv.

The Pattern of Peace Talks and Military Action

The succession of conflicting incidents captured the bleak nature of the current period. By day, diplomatic battles are fought: optimistic declarations are delivered from multiple capitals. Considerable effort is expended on containing certain initiatives. By night, Moscow clearly shows the world that, for them, war remains the key method for achieving "settlement".

Nighttime Reality

As Russia's attack unfolded into the early hours of Tuesday, the current condition of Ukraine's vulnerability was laid bare. Ukraine is able to track projectile deployments from Russian territory, a ability enabled by up-to-date information. From observation points, defense planes that had been dispatched to engage hostile guided weapons streaked across the sky – sophisticated military planes delivered to Ukraine by Western partners.

Soon thereafter, Kyiv's missile defense thundered: several firings targeted at a Russian ballistic missile. This was a modern interception technology at work, probably delivered by Western nations. Every firing jolts you unexpectedly, shaking the windows. The instant of fear quickly becomes resigned acknowledgment: perhaps the hostile projectile won't cause damage this time, protecting urban areas from devastation and another blackout.

Continuous Dangers

Following this, a large-caliber weapon fired at a aerial vehicle somewhere nearby, part of a rapid response unit – probably allied-provided weaponry. Sadly, the bullets missed the enemy aircraft – it maintained course toward its destination.

Intermittently, this carried on until dawn. Kyiv awoke to the early updates: seven people killed, devastation and heating outages in many homes as a result of the evening attack. As customarily, everyone still continued their routines – enduring hostilities. But those 24 hours demonstrated Ukraine's essential dependence on international aid – a dependence that regional partners are evidently unprepared to substitute in the near term.

Ineffective Peace Efforts

The detailed framework from American leadership sparked intense emotion, controversy and serious worry – and momentarily shifted focus from Ukraine's most significant graft case in years. Yet, we have seen this script before, after previous diplomatic encounters and international summits.

Every new initiative from American administration unfolds according to the same pattern: a political offensive against Ukraine, which Kyiv, with partner nations, manages to fend off. They stabilise the situation but never actually secure success. This pattern will, undoubtedly, endure.

Strategic Calculations

It is tempting to accuse specific actors of consistently pushing Kremlin's demands. But that does not seem to be the whole story. Washington functions according to a principle well known to seasoned negotiators: you cannot achieve through diplomacy what you have failed to defend militarily. The US administration believes that it is unfeasible to pressure the Kremlin to relinquish the territory that it currently occupies in Ukraine's south or east.

The challenge is that while accepting these circumstances, American administration does minimal to discourage Russia, through words or deeds, from assuming that the current condition will not evolve additionally in its favour in the coming year.

Conflicting Perspectives

Therefore, Moscow is certain that the clock favors them – that Ukraine and its allies are coming close to fatigue. Their incentive to accept conditions that does not give them the largest achievable advantage is virtually nonexistent. There may be numerous efforts to stop fighting, but they will continue as long as Russia's leader remains completely certain in the outcome.

On the contrary, Kyiv believes that Ukraine can still endure, gradually sacrificing people and territory but preventing a entire defensive failure until situations evolve in its benefit.

Existing Situation

Objectively, there are no genuine requirements for a ceasefire. Now, subjective factors are coming into play: leadership ambitions to negotiate peace and achieve global acclaim, and the government's dual difficulties – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the country's interests against any plan Kyiv finds unworkable, so that their attention does not switch to domestic problems. And although their task will now be much harder after latest incidents, it remains very improbable that this will modify their basic position.

These two forces are guiding negotiations.

Summary and Prospects

It took a mere seven days to kill the 28 points of the current initiative. Aggressive and erratic handling of the matter by Washington, pushback by Ukraine and the rest of Europe, along with pacifying measures of negotiators, and finally, recent disclosures, all achieved their purpose.

While new proposals based on previous concepts are approaching, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to resist political attacks from Washington that are founded on Moscow's terms and reflect specific hesitation to modify developments, if they remain united and enhance their military capacity at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to overcome them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the coming months, largely rely on sustained allied backing.
